Do you need a reason to get divorced?

In the past, couples often had to prove that there was a valid reason to get divorced. Many couples would split up after claims of adultery, for instance. If they could show that their spouse was unfaithful to the relationship, then the court would grant the divorce.

Today, things are much different. This is because most people now use a no-fault divorce, which means they don’t have to prove that their spouse did anything wrong. There’s no obligation to show that the divorce is necessary. If someone wants to end their romantic relationship with their partner, they are legally allowed to do so.

New Jersey allows for the use of certain grounds, such as cruelty or adultery. But, it is also possible to choose a no-fault divorce, which is what many people do.

What reason do they use?

When filing for a no-fault divorce, couples will still often cite reasons why they want to split up. But the most common reason is just that there are irreconcilable differences. The two of them may have run into conflict, they’re unhappy being together and they don’t think there is any way to successfully resolve the issue. That’s why they want to end the marriage.

But there’s not an obligation to show what those irreconcilable differences are. Some couples disagree about religion, others run into financial difficulties and some just drift apart over time. All of these can be a valid reason to move forward with the divorce.
