A Qualified Domestic Relations Order is integral to the division of retirement assets during a divorce. Without a QDRO, dividing retirement benefits such as 401(k) plans, pensions or other retirement accounts can become overly difficult.

Most importantly, not having a QDRO can be financially detrimental to both spouses in a divorce.

What is a QDRO?

When a couple divorces in New Jersey, the equitable distribution of assets often includes retirement accounts. A Qualified Domestic Relations Order ensures that each spouse receives their fair share of these assets according to the terms of the divorce decree. However, if a QDRO is not included in the decree, the retirement plan administrator will not have the legal authority to distribute the retirement benefits as intended.

What happens if there is no QDRO?

The absence of a QDRO can result in several complications. A spouse entitled to a portion of the retirement assets may face delays in receiving their share. This delay can cause financial strain, particularly if the retirement benefits represent a significant part of the divorce settlement.

Without a QDRO, the spouse who originally owned the retirement account retains full control over the assets.
